| marg-a Posts: 2 | IPRED2 - remedy or threat for copyright infringements? The easy acronym IPRED2 stands for IPR enforcement Directive 2 (a number 1 has already been adopted). What makes number 2 special, is that it tries to harmonize criminal law at EU level (arguably in the competence of the EU). The full title "Directive for the harmonisation of criminal measures aimed at ensuring the enforcement of IPRs" makes it clear. However, what is less clear is where the "criminalisation" starts. After the first reading by the European Parliament, some clarifications were added, like "large-scale piracy and trademark counterfeiting", especially in conjunction with organised crime. However, the Directive does not give a definition of "large scale", neither where the "private use" stops that is not criminal. The amended proposal is currently (Oct.07) waiting to be dealt with by the Council, where particularly the UK and NL are opposed to it. Amended Proposal Text
